Evaluation of Compensation Liability in the Context of Islamic Law and Modern Law

In Islamic Law, liability for compensation is discussed under the titles of damân, zimmet, khdda, gardam and kafâle. Compensation for a loss is the basis of (securing) justice. It's remarkable that not only the elements of liability -act, damage, the causal link, unlawfulness - but also some particular principles responding to changing and developing situations are taken into account for victim compensation. In this study liability for compensation will be discussed from Islamic and modern law point of view.
